The Brick Pincher Creek Valentines Day Contest

1. GENERAL

The contest shall be conducted by The Brick Warehouse LP (“The Brick”) exclusively for The Brick’s Pincher Creek Store located at 1300 Hewetson Ave, Pincher Creek, AB T0K 1W0 (hereinafter referred to as the “Store”). A participant shall be referred to as “You” or “Your”.

No purchase is necessary in order to participate in this contest.

How to enter:

• A Valentine’s Day picture will be posted on the Store’s Facebook page, as well on the Store’s Instagram account at https://www.facebook.com/TheBrickPincherCreek and @thebrickpinchercreek respectively.

• To enter the Contest, you must “Like” the post on either platform, and in the comments, identify Your favourite love song. A “Like” and a comment on a platform will be collectively referred to as “Entry/Entries”.

• Limit of one (1) on-line Entry per family per day. To enter, You must live within the Pincher Creek postal code region and/or within one hundred (100) km of the Store address.

• For this purpose, “family” means all persons, whether related or not, living in the same household who are over the age of eighteen. An Entry must be made by You using Y​​our Facebook or Instagram account. Entries made by any other individual or entity will be declared invalid. The use of any device to automate the entry process is prohibited. Any attempt to manipulate the Contest will result in You being disqualified.

• Contest dates: Commencing Thursday, February 1, 2024 at 12:00 p.m. MT, until Tuesday, February 13, 2024 at 12:00 p.m. MT (“Contest Period”)

• “Draw Date” – February 13, 2024 at 12:30 p.m. MST

• Odds of winning decrease as the number of Entries submitted increase during the Contest Period.

2. GRAND PRIZE

There is one (1) Grand Prize, listed below:
Prize: Dinner at the Pincher Creek Legion for 2 people, 2 movie tickets at the Fox Theatre and a Heartprint blanket from Small Town Collective (Prize Value: $250.00)
*Dinner includes 2 x 5oz steaks, caesar salad, baked potato and garlic bread.

Prize must be accepted as awarded and are not convertible to cash. Prize is non-transferable, non-exchangeable, and non-refundable.

Once the Winner has been confirmed, The Brick will arrange for delivery of the prize to the Winne living within 100 km of a Brick store.

3. ELIGIBILITY

The contest is open to all residents of Alberta who live in the Pincher Creek postal code region and/or within 100 km of the Store and who have reached the age of majority on or before the commencement of the Contest Period, except employees of The Brick or Leon’s Furniture Limited, and their immediate family members living in the same household.

You agree to abide by the Contest Rules as set out herein, subject to all federal, provincial and municipal laws.

It is a condition of eligibility that the Winner authorizes The Brick to announce and publish his/her name, address and photograph, without remuneration or consideration, in any forthcoming publicity.

4. DRAW DATES AND PROCEDURES FOR DETERMINING WINNER

On the Draw Date and time noted above, a representative from The Brick’s Pincher Creek Store will initiate a random, computer generated draw to select and record two (2) Entries from all eligible Entries to obtain one (1) eligible winner (“Eligible Winner”);  The additional Entry drawn is a back-up Entry in the event the initial Eligible Winner is non-responsive after contact, fails to comply with the Contest Rules, or is unable to complete the skill testing question (“Alternate Winner”).

The Brick representative will use his/her reasonable efforts to contact the Eligible Winner by Facebook’s Direct Messaging feature after the Draw Date. If the Eligible Winner has not responded to the Direct Message or has not contacted The Brick within seven (7) days of the Direct Message being sent (“Contact Date”), then that person will be disqualified and The Brick shall proceed to Direct Message the next person whose name was drawn.

5. DECLARING THE WINNER

The Eligible Winner whose Entry has been selected on the Draw Date must:

1. within seven (7) business days following the Contact Date, correctly answer a time-limited, arithmetical skill-testing question without the assistance of any person or mechanical/recording device(s). The skill-testing process shall be administered at a prearranged time and place; and
2. execute a declaration and release form confirming compliance with the contest rules and acceptance of the Prize.

Should the Eligible Winner fail to answer the skill-testing question correctly or is unable to attend at the time and place designated by The Brick for the administration of same, that Eligible Winner shall be disqualified and the skill-testing question shall be administered to the Alternate Winner.

6. ADDITIONAL TERMS

By participating, You agree that: a) these Official Contest Rules and The Brick’s records of the draw or any other aspect of this Contest shall be final and conclusive in all respects; and b) release, discharge, indemnify and hold harmless The Brick and its trustees, directors, officers, and employees from any liability, claims, damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have directly or indirectly against them or any of them in respect of or relating to the Contest and/or the acceptance or use, misuse, or possession of any prize.

7. LIMITATION OF LIABILITY

The Brick assumes no responsibility or liability for any computer, online, telephone, hardware, software or technical malfunctions that may occur (including but not limited to malfunctions that may affect the transmission or non-transmission of any Entries). If, for any reason, the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of The Brick which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, The Brick reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest.

8. PRIVACY POLICY

By entering the Contest, You agree to The Brick’s use of Your personal information for the purpose of administering this Contest and in accordance with The Brick’s Privacy Policy.

The Brick will use the contact information provided in contest entries for administration of this Contest and/or to ascertain Your needs and market to You. We may communicate with You for any of these purposes by telephone, fax, text messaging, or other electronic means, and automatic dialing-announcing device, at the numbers You have provided us, or by internet, mail, email and other methods. By entering this Contest, You acknowledge and agree to give permission to The Brick to collect, use and disclose Your personal information in accordance with The Brick’s privacy policy (“Privacy Policy”). The Brick is committed to protecting the privacy of the personal information You have provided herein. This Contest is not endorsed or sponsored by Meta Platforms, Inc, Facebook or Instagram.

The Brick reserves the right to amend or vary the Official Contest Rules, including the imposition or addition of new rules which are deemed by The Brick, in its sole discretion, necessary for business efficacy.
